Privacy Policy

1. Introduction and scope

BÉAcité is the new semi-detached home project of Maisons Pépin inc. (NEQ 1181109811, RBQ licence 8297-6796-29) in Sainte-Julie ("BÉAcité", "we", "our", "us"). This policy explains what personal information we collect on this website and in our exchanges with you, why we collect it, how we use and protect it, and the rights you have.

We handle your personal information in accordance with Law 25 (An Act to modernize legislative provisions as regards the protection of personal information), which amends Quebec's Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1). When information flows outside Quebec, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) may also apply.

This policy covers the BÉAcité website (beacite.com) and the exchanges that follow from it: information requests, newsletter sign-ups, appointments and visits. Information collected when you buy a home (contract, deposit, warranty) is governed by the sales documents provided to you at that time.

2. Person in charge of the protection of personal information

In accordance with Law 25, we have designated a person in charge of the protection of personal information. For any question, access request or complaint about your information, you can reach this person:

  • Person in charge: Janick Brochu
  • Email: ventes@beacite.com
  • Phone: (514) 812-9633
  • Address: BÉAcité sales office, 435 Geoffrion Street, Sainte-Julie, Quebec J3E 0J2

3. Personal information we collect

We collect only the information needed for the purposes described in this policy.

a) Information you provide

  • Information and visit request: your full name, email, phone number and the home or information you are interested in, as well as, if you wish, the city where you live and a message.
  • "Be the first to know about new availabilities" newsletter: your name and email, along with the date and proof of the confirmation of your subscription.
  • Exchanges and visits: the information you share with us by phone, by email or during a visit, for example your availability for an appointment and the type of home you are interested in.

b) Information collected automatically

  • When you browse the website, its statistics tool, hosted with the website, records the pages viewed, the referring page and the type of device, browser and operating system. Your IP address is converted into a hashed value (an irreversible transformation) and is not stored in clear text. This measurement sets no cookie.
  • When you send us a request, your IP address, browser type (user agent) and the page of the website your request comes from are also kept, for follow-up, security and abuse prevention. A fingerprint of your request (an irreversible digest of its content) is also kept, to recognize and ignore an identical duplicate submission.
  • If you subscribe to the newsletter, our mailings may measure whether they are opened and which links are clicked, to assess their interest.

Through the website, we do not ask for any sensitive or financial information.

4. Purposes of collection

We use your personal information to:

  • answer your information requests and send you the plans or documentation you asked for;
  • schedule your appointments and visits;
  • if you subscribe to the newsletter, inform you of new homes on offer, available lots and invitations to visits;
  • follow up on your project and provide customer service;
  • keep the website secure and prevent fraud and spam;
  • improve the website using traffic statistics;
  • comply with our legal obligations.

We do not use your information for other purposes without your consent, except where the law allows it.

5. Consent

By sending us your information through the form, by phone or by email, you consent to our using it for the purposes described above.

Your newsletter subscription is based on express consent: it only becomes active after you click the confirmation link sent to your address, and every mailing includes an unsubscribe link. An information request never subscribes you to the newsletter.

You may withdraw your consent at any time by writing to us or, for the newsletter, by using the unsubscribe link. This withdrawal may, however, be limited by certain legal or contractual obligations.

6. Cookies and similar technologies

The website sets no advertising cookie and no audience measurement cookie. It only keeps, in your browser, the choice you make in the consent banner and your display language.

This Law 25 compliant banner groups cookies into categories: necessary (always active), analytics, marketing, personalization and social media. To date, no tool from categories other than "Necessary" is used on the website. If such a tool is added, for example Google Analytics, it will only be activated with your consent, and this policy will be updated. You can change your choices at any time using the cookie button at the bottom of every page.

When a form on the website is displayed (information request or newsletter), the Google reCAPTCHA anti-spam service is loaded to protect it. Google may then collect technical data, for example your IP address and information about your browser, under its own privacy rules.

The links to our Facebook and Instagram pages, the share buttons and the "View on map" link at the bottom of the page load no tool from these services: no data is sent to them unless you click one of them. Once on their site, their own privacy rules apply.

7. Disclosure to third parties

Within Maisons Pépin inc., only the people who need it for their work, in particular the sales team, have access to your information. We disclose it only to the providers who need it to serve us, and always under confidentiality commitments:

  • our email provider (Google Workspace), where we receive your requests and emails;
  • our email delivery provider (Resend), which receives the content of your requests and some technical data, such as the IP address, in order to notify us and confirm receipt to you, and which delivers the confirmation emails and newsletter mailings;
  • Google, for the reCAPTCHA anti-spam service;
  • our website hosting and management provider (MaPlateforme.ca);
  • public authorities, when required by law.

We never sell, rent or trade your personal information.

8. Disclosure or storage outside Quebec

Some providers, including Google and Resend, may process or host information outside Quebec, notably in the United States. Before any such disclosure, a privacy impact assessment (PIA) is carried out, as required by Law 25, to make sure your information receives adequate protection. These disclosures are also governed by PIPEDA.

9. Retention and destruction

We keep your personal information for as long as needed for the purposes for which it was collected, or for as long as our legal obligations require. Your newsletter subscription is kept until you unsubscribe; after you unsubscribe, we keep only your address and the date of your withdrawal, so that your choice is respected. Visit statistics are deleted automatically after about 13 months. When information is no longer needed, we destroy or anonymize it securely.

10. Security measures

Reasonable physical, technological and administrative measures protect your information, including:

  • encrypted data transmission (HTTPS/TLS);
  • hashing of IP addresses for statistical purposes;
  • restricted and protected administrative access;
  • request rate limiting and anti-spam protection of the forms;
  • regular backups of the website.

Despite these measures, no system is infallible and we cannot guarantee absolute security.

11. Your rights

Subject to the conditions set out in the law, you may:

  • access the personal information we hold about you;
  • request the correction of inaccurate, incomplete or equivocal information, or the deletion of outdated information or information whose retention is no longer justified;
  • withdraw your consent to its use;
  • request the portability of your information, that is, receive it in a structured, commonly used technological format;
  • request de-indexing or the cessation of the dissemination of information, in the cases provided for by law;
  • be informed when a decision is based exclusively on automated processing of your information.

To exercise these rights, write to our person in charge, Janick Brochu, at ventes@beacite.com. We respond within 30 days at most. We may need to verify your identity before acting on your request.

12. Information about minors

Our services are intended for adults. We do not knowingly collect personal information about a person under 14 without the consent of the person having parental authority. If you believe a child has sent us information, write to us so that we can delete it.

13. Confidentiality incident

In the event of a confidentiality incident that presents a risk of serious injury, we take reasonable measures to reduce its consequences, we promptly notify the persons concerned and the Commission d'accès à l'information, and we keep a register of incidents, in accordance with Law 25.

14. Complaints to the authorities

If you believe we have not respected your rights, we invite you to first write to our person in charge. You also have the right to file a complaint with the Commission d'accès à l'information du Québec (CAI): www.cai.gouv.qc.ca, 418 528-7741 or 1 888 528-7741. For activities covered by federal law, you may contact the Office of the Privacy Commissioner of Canada: www.priv.gc.ca, 1 800 282-1376.

15. Changes to this policy

We may change this policy from time to time to reflect changes in our practices or in the law. The date of the last update appears at the top of this page. In the event of a significant change, we will take reasonable steps to inform you.
